End User License Agreement

1. License Grant
Subject to the terms of this Agreement and your active subscription, Nfinit Monkeys LLC grants you a limited, non-exclusive, non-transferable, revocable license to access and use the FieldDay platform ("Software") for your internal business operations.
2. Restrictions
You shall not:
- Copy, modify, or create derivative works of the Software
- Reverse engineer, decompile, or disassemble the Software
- Rent, lease, lend, sell, sublicense, or distribute the Software to third parties
- Remove or alter any proprietary notices, labels, or marks
- Use the Software to build a competing product or service
- Circumvent any technical limitations or access controls
- Use automated scripts or bots to access the Software beyond approved API usage
3. Intellectual Property
The Software, including all code, design, features, documentation, and trademarks, is the exclusive property of Nfinit Monkeys LLC. This Agreement does not transfer any ownership rights to you. All rights not expressly granted are reserved.
4. Your Content
You retain all rights to data, documents, images, and other content you create or upload through the Software ("Your Content"). You grant us a limited license to process, store, and display Your Content solely for the purpose of providing the Service.
5. AI-Generated Content
Content generated by AI features (estimates, call summaries, follow-up messages) is provided under your account and becomes Your Content. However, we do not warrant that AI-generated content is free from errors. You are responsible for reviewing and approving all AI outputs before use with customers.
6. Updates and Modifications
We may update the Software from time to time. Updates may include new features, bug fixes, security patches, or changes to existing functionality. Continued use of the Software after updates constitutes acceptance. We will provide notice of material changes that significantly alter functionality.
7. Warranty Disclaimer
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8. Termination
This license is effective until terminated. We may terminate this license immediately if you breach any provision of this Agreement. Upon termination, you must cease all use of the Software. Sections 3, 7, and 9 survive termination.
9. Governing Law
This Agreement is governed by the laws of the State of Michigan. Any disputes shall be resolved in the courts of Oakland County, Michigan.
